1.1. For the purpose of these Terms, the terms defined in this Clause, and elsewhere in these
Terms, will have the following meanings:
(a) “Business Users” means a body corporate, partnership or enterprise that is registered on the Site;
(b) “Buyer” means a registered User which transacts on the Site by using his/her Points in exchange for Items;
(c) “Individual Users” means a natural person that is registered on the Site;
(d) “Items” means the goods and/or services offered by the Sellers on the Site;
(e) “Points” means the points of credit received by registered Users in exchange for pledging their goods and/or service on the Site;
(f) “Qu” or “we” or “us” mean MSME New Media Sdn Bhd (Company No: 1126412-U);
(g) “Seller” means a registered User which transacts on the Site by selling his/her Items to a Buyer;
(h) “Services” means e-commerce business activities including but not limited to providing an online platform which facilitates barter trade between users, or such other services as Qu may introduce from time to time;
(j) “User” means a Business User or an Individual User which uses the Site;
(k) “User Content” means any content posted to, or sent on, the Site by Users; (l) “Site” means the Qu mobile application; and
(m) “Wallet” means the Qu Wallet, a feature on the Site that stores the User’s Points.
2.1. If there is any inconsistency between the provisions of these Terms and any agreement subsequently entered into between you and Qu, the agreement shall prevail.
2.2. In these Terms, any reference to any legal entity or individual person includes, where appropriate, a reference to its authorised agents, delegates, successors or nominees. Expressions in the singular form include the plural and vice versa.
2.3. No rule of law (or interpretation to the effect) that an ambiguity in a document is to be construed against the party drafting or preparing such document shall apply in respect of these Terms.
2.4. Any reference to any law, statute or regulation or enactment shall include references to any statutory modification or re-enactment thereof, or to any regulation or order made under such law, statute or enactment (or under such a modification or re-enactment).
2.5. The headings used in these Terms are for convenience of reference only and are not to affect the construction of, or to be taken into consideration in, interpreting these Terms.
3. SERVICES PROVIDED
3.1. These Terms set out the terms and conditions under which Qu will provide the Services to you on the Site. You agree that Qu shall have sole and absolute discretion to determine whether the Services are to be provided by Qu, and Qu may refuse to provide any Services without giving any reason or without incurring any liability to you as a result.
3.2. The Site is provided to you for your use subject to these Terms, the Terms and Conditions, or other relevant policies. By using the Site, you agree to be bound by these Terms. You are also responsible for ensuring that all persons who access the Site through your Internet connection or account are aware of these Terms and other applicable terms and conditions, and that they comply with them.
4.1. You understand, acknowledge and agree that we are not a seller of the items listed on the Site; that we are not an advertiser of any of the items listed on this Site; and that we are not a party to the transactions between Users on the Site. The Site only provides a platform for Users to privately transact for Items, and:
(a) we are not involved in the actual transaction or transfer of Items between Users;
(b) we make no representation as to the quality, safety, morality or legality of any aspect of the Items listed;
(c) we make no representation as to the truth or accuracy of the listings, the ability of Sellers to sell Items or the ability of Buyers to pay for Items;
(d) we are not a bank or any other kind or form of financial institution and all Points credited to your account are not actual cash deposits, do not earn interest, and are only account entries that entitle you to the amount of the credited Points if you use them in accordance with these Terms;
(e) we make no representation as to the accuracy of other Users’ details; and
(f) we make no representation that Users will complete the transfer of the Item or deliver the Item to the Buyer; or that a User has truthfully and accurately described an Item posted on the Site; or that the transfer of an Item complies with applicable legal requirements for the transaction.
4.2. You understand, acknowledge and agree that Qu does not and will not assume any advisory, fiduciary or similar other duties. You understand, acknowledge and agree that you have taken, or will take, the necessary independent legal or other advice before Qu provides Services to you and before you transact with any User.
5. PERSONAL DATA PROTECTION
You agree that Qu may collect, store, process, disclose, access, review and/or use personal data (including sensitive personal data) about you, whether obtained from you or from other sources in accordance with the Personal Data Protection Act 2010 for purposes of rendering the Services and in connection with the operation of the Site. You further acknowledge and agree to the Privacy Notice as displayed on the Site.
6. USE OF SERVICE
(A) Business Users
6.1. Only Business Users may pledge their Items in exchange for Points. All Points may be used in exchange for Items from other Business Users on the Site.
6.2. Points will be credited to your account upon completing the pledging process as set out on the Site. Specifically, one (1) Point will be granted for every one Ringgit Malaysia (RM 1) worth of Items pledged on the Site.
6.3. In consideration of the Points granted in Clause 6.2, the Business User agrees, covenants and undertakes that upon the receipt of a request from Buyers with adequate Points for the User’s Items, the User shall take all necessary steps to promptly deliver or procure the delivery of the Items to the Buyer.
6.4. Business Users shall have the option to obtain Points by topping up for cash on their respective
Wallet in accordance with the terms and conditions of the Wallet Terms and Conditions.
(B) Individual Users
6.5. Individual Users shall only able to obtain Points by topping up for cash on their respective Wallet or upon the receipt of Points from their respective employer’s Business Accounts in accordance with the terms and conditions of the Wallet Terms and Conditions.
6.6. Individual Users shall not be eligible to make pledges on the Site.
6.7. Points will be deducted from your account whenever you have completed a transaction for Items. The amount of Points deducted shall be reflective of the consideration of the transaction. Users are still able to transact with the balance Points in accordance to these Terms.
6.8. Qu will maintain a record of the Points credited to and debited from your account and allow you to check the status of your account online by logging in and checking the Qu Statement. Although Qu makes every effort to ensure that accounts are credited correctly, it is your responsibility to verify that your Points have been credited properly. If you feel the Points credited to your account are incorrect, you must contact Qu via email within 14 days following the alleged error and explain in full the basis of your dispute, attaching any relevant information which offers evidence of the discrepancy. Upon receipt of your notice, we will investigate your claim and notify you of our decision to adjust or maintain the amount of Points credited to your account, as we deem appropriate, within thirty (30) days. If we need additional time to decide your claim, we will notify you and will endeavor to render a decision as soon as reasonably practicable. Any decision by us with regard to such a claim will be final.
6.9. Points have no cash value, and may not be assigned, transferred and/or pledged to any third party, without Qu’s written consent.
7.1. In consideration for the Business User pledging its Items on the Site, Qu shall provide the Business User with Points of commensurate value in accordance with Clause 6.2. Qu reserves the right to charge a pledge fee for each pledge that is made by a Business User which may be paid in cash for the initial pledge, and in Points for subsequent pledges, or any other manner in which may be communicated to you in writing by Qu.
7.2. The Business User has the option to enable a feature which enables automatic pledges that would be made every time after a previous pledge has been fulfilled. If the Business User enables such a feature, the Business User is deemed to have accepted that each and every pledge that is made is valid and binding on the Business User and the Business User shall be obligated to fulfil the pledge in accordance with these Terms.
7.3. The Business User represents and warrants to Qu that the Items pledged, where applicable, are:
(a) valid and that the Business User is the legal and beneficial owner of the Items; (b) readily saleable and are valued at the fair market value of the Items; and
(c) free from any lien, security interests, charges or encumbrances.
7.4. The Items pledged pursuant to these Terms shall be continuing security for the provision of these Items upon demand of a sale subsequently by a Buyer to the Business User.
7.5. The Business User agrees that it shall have the responsibility to ensure that the Items are adequately insured against any loss and/or damage.
7.6. Only Business Users are eligible and able to make pledges on the Site.
8. Event of Default
8.1. Upon the occurrence of any of the following events, each of which shall constitute a default
(“Event of Default”):
(a) failure of the Business User to respond to a request to purchase an Item initiated by a
Buyer, as set out in Clause 6.3 within 3 days from the date of demand;
(b) any default on the part of User in the performance of any covenant, term or other provision of these Terms;
(c) a petition is presented, or a proceeding is commenced, or an order is made or an effective resolution is passed for the winding-up, insolvency, administration, judicial management, reorganisation, reconstruction, dissolution or bankruptcy of the User or for the appointment of a liquidator, receiver, administrator, judicial manager, trustee or similar officer of the User or of all or any part of the User’s business or assets or upon a User being adjudged a bankrupt;
(d) the Business User creates an encumbrance or a security interest in the Item that has been pledged for sale on the Site; or
(e) the Business User fails to do all things necessary to preserve and maintain the value of the Item pledged for sale on the Site,
and in addition to Qu’s right to exercise any rights or remedies provided under law or any other applicable statute, Qu may, in its sole discretion:
(i) seek specific performance from a Court of competent jurisdiction to compel the Business
User to honour its obligations under the pledge;
(ii) terminate the pledge without notice and to nullify and re-claim the Points received with respect to the pledge; and/or
(iii) to terminate the User’s registration from the Site.
9. TRANSACTIONS ON THE SITE
9.1. We do not transfer legal or beneficial ownership of Items from a Seller to a Buyer, and nothing in these Term shall modify the applicable laws relating to the transfer of legal or beneficial ownership of an item upon physical delivery of the Item. Unless the transacting Users agree otherwise, each User will become the Item’s lawful owner upon payment of Points and physical receipt of the item, in accordance with applicable laws.
9.2. If you engage in transactions on the Site, you agree to comply with all applicable legal requirements governing the specific requirements for transfer and shipping of Items.
9.3. You may not use the Site for transactions involving any illegal goods or services, including any:
(a) illegal goods, or any substance or device that may pose a threat to other Users and the general public;
(b) prescriptions, prescription drugs or devices; (c) stocks or securities of any kind;
(d) drug paraphernalia; (e) plants or seeds;
(f) bombs, bomb making supplies, or instructions on how to make bombs; (g) exotic animals, endangered animals, or products made from such;
(h) sexually explicit material, including pornography; (i) weapons, firearms, or ammunition;
(j) stolen or counterfeit goods; or
(k) alcohol, cigarettes, or tobacco.
The above list is not exhaustive and we reserve the right to modify this list at any time without prior notice.
10. OBLIGATION TO SUPPLY
10.1. Notwithstanding that a Business User has not made a pledge to offer for sale any of its Items on the Site, the Business User shall have the obligation to supply its Items on the Site at the point of completion of registration with the Site. Business Users agree and acknowledge that this is a continuing obligation throughout the term in which it is registered on the Site. Each obligation to supply shall require a Business User to make available its Items up to a value of RM 30,000 if a Buyer makes such a request to the Business User or Qu. In the event a Business User refuses to comply with such a request, Qu may then remove the Business User from the Site and the Business User shall not have any recourse against Qu or the Site, or any of the subsidiaries or associate companies of Qu or the Site, for such removal. In consideration for supplying its Items, the Business User shall receive Point of commensurate value from the Buyer.
10.2. Upon making a pledge of its Items, the Business User shall be required to honour its pledge in accordance with these Terms and such other terms and conditions on the Site.
11. MESSAGING SERVICE
11.1. We retain the discretion whether to publish, edit, delete, block, reject, take down or remove any part or all of any User Content. However, we have no obligation whatsoever to monitor or independently verify any User Content or to edit, delete or refuse to post or transmit any User Content.
11.2. As a Buyer, you may transmit User Content to Sellers strictly for the purpose of enquiring about the goods and/or service offered by the Seller. As a Seller, you are prohibited from initiating any messages to any User, but you may able to respond to a message request when initiated by a Buyer strictly for the purpose of negotiating and concluding a transaction. In any event, we retain the right to store and process any User Content sent on the Site.
11.3. Qu absolutely prohibits and will not be responsible or liable for the content of any material (including but not limited to the User Content) posted to this Site by us or by third parties which is defamatory, offensive, obscene, inaccurate, misleading, unlawful, pornographic or which in any way infringes a third party rights, including but not limited to intellectual property rights.
11.4. You are prohibited to use the Services to send automated, unsolicited or unauthorised messages, advertising or promotional material or any junk mail, spam or chain letters.
11.5. You retain all intellectual property rights in your User Content. You grant us an irrevocable, royalty free, perpetual, worldwide licence to use, modify, transmit, communicate to the public, reproduce and sublicense your User Content in any form, including on the Site and in any print or electronic publication.
11.6. You consent to us doing or omitting to do any and all acts in relation to your User Content that would otherwise infringe any past, existing or future moral rights in the User Content. You waive any rights you may have to take action against us in relation to any act or omission which would otherwise infringe any past, existing or future moral rights in your User Content.
11.7. You warrant that the User Content is your original work and you own all rights in relation to the User Content. You indemnify us against any action, claim or proceedings alleging that the User Content infringes the rights of any person, and any cost, charge, expense, payment, loss, damage or liability suffered or incurred by us in connection with the foregoing.
11.8. You must not include, in your User Content, any links to any third party Sites, except where such third party Sites belong to you.
11.9. To the extent permitted by law, we will be under no liability to you in respect of any loss or damage which you may suffer or incur or which may arise directly or indirectly in connection with your supply of User Content to our public forums and blogs, or the subsequent use of your User Content by us or any third parties.
11.10.We reserve our right to refuse to transmit or to remove or alter any User Content (in whole or in part), the transmission or the posting of which would in our sole discretion violate any right of any person or constitute an offence or a breach of any policy, notice or other requirement of ours.
12. REPRESENTATIONS AND WARRANTIES
The User represents and warrants to Qu that:
(a) if the User is a body corporate, it is either a Malaysian registered sole proprietorship, Malaysian registered partnership, limited liability partnership, private or public limited company, or an unlisted public company incorporated under Malaysian laws;
(b) if the User is an individual, that he/she is at least eighteen (18) years of age;
(c) it is solvent, and there are no reasonable grounds to suspect that it is unable to pay its debts as and when they become due and payable;
(d) it has the legal capacity to enter into, perform and deliver these Terms and to perform its obligations under these Terms and the relevant agreements. Furthermore, the User has taken all necessary actions to authorise its entry into, performance and delivery of any obligations created under these Terms and the relevant agreements;
(e) the obligations assumed by the User in these Terms and the relevant agreements constitute the legal, valid, binding, and enforceable obligations of the User;
(f) all information provided by the User to Qu does not contain any false or misleading statements, or any material omission, and is true and accurate in all material respects on and as at the date it was provided;
(g) there is no action, suit, or proceeding at law, equity, or before any court, tribunal, governmental body, agency or official or any arbitrator (whether pending or threatened) that is likely to affect the legality, validity or enforceability of these Terms or the relevant agreements, or affect the User’s ability to perform its obligations;
(h) it will comply with all applicable legal requirements in listing, agreeing to trade, transferring and shipping, and buying and/or selling all Items;
(i) it will be solely responsible for compliance with all applicable export or import controls with respect to any transactions of Items; and
(j) it will comply with all legal requirements regarding the reporting, collection, withholding and payment of all sales and service tax and/or other taxes and duties applicable to the transfer and transport of each Item.
13.1. The User authorises Qu to:
(a) obtain and verify any information about the User as Qu may, in its sole and absolute discretion, deem fit; and
(b) disclose any information and/or data relating to the User and its account(s) or any other information as Qu may deem necessary to:
220.127.116.11 any of the User’s head office, representative and branch offices and/or any related company or associated company of the User, in any jurisdiction;
18.104.22.168 any government or regulatory agency or authority;
22.214.171.124 any of the User’s potential assignees or transferees (subject to the prior consent of Qu);
126.96.36.199 any other third parties, service provider, agents or business partners wherever situated for any purpose whatsoever; and/or
188.8.131.52 any other person to whom disclosure is permitted or required by the Law.
The User agrees to indemnify and render harmless Qu and its officers against all losses, taxes, expenses, costs, legal fees, and liabilities (present, future, contingent or otherwise on any indemnity basis), which may be suffered or incurred by Qu as a result of or in connection with the User’s breach of the Terms or the relevant agreements and/or any steps taken by Qu in the event of a breach of these Terms or the relevant agreements.
15. EXCLUSION AND LIMITATION OF LIABILITY
15.1. Neither Qu nor any of its officers shall be liable in contract, tort (including negligence or breach of statutory duty) or otherwise, for: (i) any loss of profit, business or revenue, (ii) any costs or expenses, or any special, indirect or consequential damages of any nature whatsoever, suffered or incurred by the User as a result of or in connection with the provision of the Services.
15.2. We do not review User’s posting’s or User Content and we are not involved in the actual transaction between Users. As most content on the Site comes from other Users, we do not guarantee the accuracy of postings or User communications or the quality, safety or legality of any Items offered. You agree to not hold us responsible for the acts and omissions of the Users on the Site.
15.3. We do not accept liability for any description of any User’s submissions which may contain unlawful, threatening, abusive, defamatory, obscene or indecent information, or material of any kind which violates or infringes upon the rights of any other person, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law.
15.4. You acknowledge that we cannot guarantee continuous, error-free or secure access to our Services or that defects in the Service will be corrected. While we will use reasonable efforts to maintain an uninterrupted Service, we cannot guarantee this and we do not give any promises or warranties (whether express or implied) about the operation and availability of our Site, Services, applications or tools.
15.5. To the extent legally permitted, we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of, or inability to use the Site, even if you advise us or we could reasonably foresee the possibility of any such damage occurring. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you. Despite the previous paragraph, if we are found to be liable, our liability to you or any third party (whether in contract, tort, negligence, strict liability in tort, by statute or otherwise) is limited to the greater of (a) the total fees you pay to us in the 12 months prior to the action giving rise to liability, and (b) five hundred Ringgit
16. TIME OF ESSENCE
It is a fundamental term of the relationship between the parties that the User will perform its obligations on time.
17. INDEPENDENT CONTRACTORS
The Users and Qu are independent contractors. No agency relationship, partnership, joint venture, employer-employee relationship or franchisor-franchisee relationship is intended or created by this Agreement.
18 NO WAIVER OF RIGHTS
A failure or delay in exercising any right, power or privilege in respect of these Terms will not be presumed to operate as a waiver, and a single or partial exercise of any right, power or privilege will not be presumed to preclude any subsequent or further exercise of that right, power or privilege or exercise of any other right, power or privilege.
Qu may at any time, give the User notice of any amendment, variation, revision, supplement or any other change to these Terms by post, e-mail or such other means as Qu shall deem fit. Changes shall take place on and from the date specified in the notice or if no such date is specified, on and from the date of such notice. Without prejudice to the foregoing, the entry into or continued entry into the Services after such change shall be deemed as the User’s acceptance and agreement to the same.
20. GOVERNING LAW AND JURISDICTION
20.1. These Terms will be governed and construed in accordance with laws of Malaysia.
20.2. With respect to any suit, action or proceedings relating to any dispute arising out of or in connection with these Terms, each party submits to the exclusive jurisdiction of the courts of Malaysia.

Pursuant to the statutory requirements of the Personal Data Protection Act 2010 (“PDPA”), this privacy notice for personal data (“Privacy Notice”) is issued to all users of the Qu Exchange (“Site”) (incorporated as MSME New Media Sdn Bhd. (Company No: 1126412-U) (“Qu”, “we”, “us” or “our”).
Personal data that we collect about you
Personal data means any information in our possession that relates directly or indirectly to an individual to the extent that the individual can be identified from that and from other information in our possession such as your name, address, telephone numbers, NRIC No., date of birth, email address, photograph, your IP address, operating system, browser type as well as information and data generated in the ordinary course of the relationship with us which may include signatures, answers to questions intended for security verification, emergency contact numbers and call back contact details. We also collect service-related, diagnostic, and performance information.
Purposes for which your personal data is used and disclosed
During the course of your use of our services, we are required to collect and process your personal data to process facility applications submitted by you, to verify your identity, update our records and generally maintain an account with us, perform credit assessment and other background checks on you, to perform research, evaluation, administrative and operational tasks (including market or customer survey, due diligence, service improvement and product development, risk management, systems development, credit rating, and training), provide our Services and customise the content shown to you, develop, operate, improve, deliver and maintain our Services, responding to your queries and resolving complaints, carry out polls, surveys, analysis and research on how our Services are being used and how we can improve them, to update you on your listings and our Services, to send you marketing and/or promotional materials on our latest products and services or carefully selected third parties, to send service -related messages including, without limitation, a welcome/confirmation email when you register your Account and to enforce our Terms of Service and other policies, to administer our systems, and for all other purposes that are ancillary and incidental to our business (collectively referred to as “Permitted Purposes”).
How we collect your personal data
Parties to whom your personal data may be disclosed
Your personal data will not be disclosed by us to any third party without your consent, save for disclosures to:
(a) our group of companies (including Qu’s parent company, subsidiaries, related and/or associated companies);
(b) our business partners, vendors, suppliers, agents, contractors, agents, service providers, insurance companies, investors, professional advisers, banks and/or financial institutions;
(c) our auditors, business consultants, accountants, lawyers or other professional advisers and/or consultants as we deem necessary and appropriate;
(d) to any party who undertakes to keep your personal data confidential only to the extent
necessary to fulfil the relevant Permitted Purposes, or to whom we are compelled or required by law to disclose to, including disclosure to courts, tribunals, legal, regulatory, tax and other government authorities;
(e) any actual or proposed assignee of Qu or transferee of Qu’s rights in respect of all or part of the assets or business of Qu; or
(f) other Users of our Services.
It is necessary for us to collect and process your personal data. Without your consent authorising us to process and collect your personal data, we will not be able to effectively provide our services to you, or to process your personal data in relation to the Permitted Purposes.
True, accurate and complete personal data
By providing us with your personal data, you are consenting for us to act as data user for the purposes of the PDPA and to be able to collect and process your personal data in accordance with this Privacy Notice. You confirm that all personal data that is provided to us is true, accurate and complete, and that none of the personal data provided is misleading or outdated. In the event of any change to your personal data, you will promptly update us.
Third party’s personal data
To the extent that you have provided (or will provide) personal data about your family members, spouse, other dependents (if you are an individual), or to the extent that you have provided (or will provide) personal data about your directors, partners, shareholders, employees, representatives, agents (if you are a corporate entity/an organisation) and/or other individuals (such as beneficial owners, payors, payees, guarantors, authorised signatories, other security providers and other natural person related to you), you confirm that you have explained (or will explain) to them that their personal data will be provided to, and processed by, us and you represent and warrant that you have obtained their consent to the processing (including disclosure and transfer) of their personal data in accordance with this Privacy Notice.
Your rights under the PDPA
It is our priority that your personal data is stored in a secured state. The duration of data storage shall be for as long as it is necessary in relation to our business and/or as permitted by the PDPA. You have a right, under the PDPA, to request access to, request for a copy of and to request a correction of the personal data and to contact us with any inquiries or complaints in respect of your personal data. Subject to our right to rely on any statutory exemptions and/or exceptions to collect, use and disclose your personal data, you have the right at any time to request us to limit the processing and use of your personal data.
You may be given the opportunity to ‘opt-out’ of having your personal data which may be used to provide information about products, services and/or third party services and/or products, which may be of interest to or benefit you. If you choose to ‘opt-out’, we will not be able to provide you with such information.

Amendment to this Privacy Notice
We reserve the right to update and amend this Privacy Notice from time to time. We will notify you of any amendments to this Privacy Notice via announcements on our Site or other appropriate means. If we amend this Privacy Notice, the amendment will not have any retrospective effect on personal data collected before the revised Privacy Notice.
English version shall prevail
In accordance with Section 7(3) of the PDPA, this Privacy Notice is issued in both English and Bahasa Malaysia. In the event of any inconsistencies or discrepancies between the English version and the Bahasa Malaysia version, the English version shall prevail.

Data peribadi bermaksud maklumat dalam pegangan kami yang berkait samada secara langsung atau tidak kepada seseorang individu setakat membolehkan pengecaman individu ataupun pengecaman individu daripada maklumat lain dalam pegangan kami seperti nama anda, alamat, nombor- nombor telefon, nombor kad pengenalan, tarikh lahir, alamat emel, gambar, alamat IP anda, sistem pengendalian, jenis pelayar serta apa -apa maklumat dan data yang dijana di dalam keadaan perhubungan biasa dengan kami yang mungkin merangkumi tandatangan, jawapan untuk soalan pengesahan keselamatan, nombor-nombor telefon kecemasan dan maklumat panggilan semula. Kami juga mengumpul maklumat yang berkaitan dengan perkhidmatan, diagnostik dan maklumat prestasi.
Tujuan penggunaan dan pendedahan data peribadi anda
Sepanjang urusan anda dengan kami, kami akan mengumpul dan memproses data peribadi anda untuk tujuan memproses permohonan kemudahan yang dihantar oleh anda, untuk mengesahkan identiti anda, mengemas kini rekod kami dan mengekalkan akaun kami, melakukan penilaian kredit dan latar belakang lain menyemak tugas, melakukan pemeriksaan, evaluasi, tugas administrasi dan operasi (termasuk survei pasar atau pelanggan, ketekunan wajar, peningkatan pelayanan dan pengembangan produk, manajemen risiko, pengembangan sistem, peringkat kredit dan pelatihan), menyediakan Perkhidmatan kami dan menyesuaikan konten yang ditunjukkan kepada anda, membangunkan, mengendali, meningkatkan, menyampaikan dan mengekalkan Perkhidmatan kami, menjawab pertanyaan anda dan menyelesaikan aduan, menjalankan tinjauan, tinjauan, analisis dan penyelidikan mengenai bagaimana Perkhidmatan kami digunakan dan bagaimana kami dapat memperbaikinya, untuk mengemas kini anda pada penyenaraian anda dan Perkhidmatan kami, untuk menghantar anda pemasaran dan / atau bahan promosi pada produk dan perkhidmatan kami yang terkini atau pihak ketiga yang dipilih dengan teliti, untuk menghantar mesej yang berkaitan dengan perkhidmatan termasuk, tanpa had, e-mel pengemukaan / pengesahan apabila anda mendaftarkan Akaun anda dan untuk menguatkuasakan Syarat Perkhidmatan kami dan dasar lain, untuk mentadbir sistem kami, dan untuk semua tujuan lain yang bersampingan dan bersampingan dengan perniagaan kami (secara kolektif dirujuk sebagai “Tujuan yang Dibenarkan”).
Bagaimana kami mengumpul data peribadi anda
Kami akan mengumpul data peribadi anda, apabila anda mendaftar untuk akaun dengan kami atau sepanjang urusan kami dengan anda menerusi permohonan dan borang-borang lain yang dihantarkan oleh anda melalui laman web kami atau sebaliknya, surat-surat tawaran, perjanjian yang ditandatangani anda dan akses anda ke laman web kami atau apabila anda memilih untuk menyambungkan akaun anda dengan perkhidmatan atau aplikasi pihak ketiga luaran, dan maklumat peribadi anda yang didapati daripada biro kredit dan agensi pelaporan kredit. Kami juga akan mendapatkan maklumat mengenai penggunaan am internet anda dengan menggunakan cookies yang disimpan di dalam cakera keras komputer anda. Sesetengah pihak ketiga yang mengiklankan di laman web kami juga akan menggunakan cookies tetapi kami tidak mempunyai akses atau kawalan ke atas mereka. Anda boleh menetapkan pelayar web anda untuk menolak cookies, namun sekiranya anda menetapkan sedemikian, anda bermungkinan tidak dapat menikmati penggunaan laman web kami secara sepenuhnya. Selain itu, dengan penerimaan perkhidmatan kami, penaja jamin kredit (credit underwriters) kami akan menghubungi mana-mana pihak berkuasa yang berkaitan, biro kredit dan agensi pelaporan kredit (termasuk CTOS dan CCRIS) atau individu-individu bagi menentukan, menentusahkan dan/atau mengesahkan maklmuat-maklumat relevan berkaitan dengan (tetapi terhad kepada) rekod undang-undang atau kredit anda bagi tujuan menjalankan ketekunan wajar. Maklumat peribadi anda juga mungkin dikumpul daripada pelbagai sumber, termasuk dan tidak terhad kepada, semasa mesyuarat, acara, seminar, persidangan, ceramah, pameran bergerak, kaji selidik yang dianjurkan atau ditaja oleh pihak kami, dan juga dari sumber domain awam. Ini termasuk sebarang komuikasi oleh atau kepada kami.
Pihak-pihak yang akan menerima data peribadi anda
Data peribadi anda tidak akan didedahkan oleh kami kepada mana-mana pihak ketiga tanpa kebenaran anda, kecuali kepada:
(g) syarikat-syarikat di dalam kumpulan Syarikat (termasuk syarikat induk Qu, subsidiari, syarikat berkaitan dan/atau syarikat bersekutu kami);
(h) rakan kongsi perniagaan, vendor, pembekal, ejen, kontraktor, pembekal perkhidmatan, biro kredit, agensi pelaporan kredit, syarikat insurans, penasihat professional, bank dan/atau institusi kewangan yang memberi perkhidmatan perbankan, pelabur, kiriman wang, pentadbiran, perkhidmatan pos, telekomunikasi, pusat panggilan, proses perniagaan, perjalanan, visa, pengurusan ilmu, sumber manusia, memprosesan data, teknologi maklumat, komputer, pembayaran, kutipan hutang, semakan rujukan kredit atau penjelasan sekuriti (securities clearing) atau perkhidmatan lain kepada kami;
(i) juruaudit, perunding perniagaan, akauntan, peguam atau penasihat profesional lain kami dan/atau perunding yang kami fikirkan perlu dan sesuai;
(j) mana-mana pihak yang mengaku janji untuk menyimpan data peribadi sulit setakat perlu untuk
memenuhi Tujuan-Tujuan yang Dibenarkan yang berkaitan, atau kepada siapa kami diarahkan atau dikehendaki oleh undang-undang untuk mendedahkan kepada, termasuk pendedahan kepada mahkamah, tribunal, undang-undang, badan kawal selia, cukai dan pihak berkuasa kerajaan yang lain;
(k) mana-mana pemegang serah hak atau yang dicadangkan bagi Qu atau penerima pindahan hak
Qu berkenaan dengan semua atau sebahagian aset atau perniagaan Qu; atau
(l) Pengguna lain Perkhidmatan kami.
Mengumpul dan memproses data peribadi anda adalah satu keperluan bagi kami. Tanpa keizinan anda untuk kami memproses and mengumpul data peribadi anda, kami tidak dapat memberi perkhidmatan kami kepada anda secara efektif atau untuk memproses data peribadi anda bagi Tujuan-Tujuan yang Dibenarkan.
Data peribadi yang benar, tepat dan lengkap
Dengan memberikan kami data peribadi anda, anda bersetuju untuk membenarkan kami bertindak sebagai pengguna data bagi tujuan PDPA dan untuk mengumpul dan memproses data peribadi anda menurut Notis Privasi ini. Anda juga memberi kebenaran kepada biro kredit dan agensi pelaporan kredit untuk mengumpul dan memproses data peribadi anda daripada kami berdasarkan Notis Privasi ini. Anda bersetuju bahawa kesemua data peribadi yang telah diberikan kepada kami adalah benar, tepat dan lengkap, dan bahawa tidak ada data peribadi yang berniat untuk mengelirukan atau adalah lapuk. Sekiranya berlaku apa-apa perubahan kepada data peribadi anda, anda perlu memaklumkan kepada kami dengan segera.
Data peribadi pihak ketiga
Segala data peribadi yang anda berikan (atau akan berikan) berkaitan dengan ahli keluarga anda, pasangan, tanggungan lain (jika anda seorang individu), atau segala data peribadi yang anda berikan (atau akan berikan) berkaitan dengan pengarah, rakan kongsi, pemegang saham, pekerja, wakil, ejen (sekiranya anda adalah badan korporat atau organisasi) dan/atau lain-lain individu (seperti pemilik benefisial, pembayar, penerima bayaran, penjamin, penandatangan yang sah, penyedia sekuriti (security providers) dan lain-lain orang sebenar yang berkaitan dengan anda, telah dijelaskan (atau akan dijelaskan) oleh anda bahawa data peribadi mereka akan diberikan kepada, dan diproses oleh, kami dan anda mewakilkan dan menjamin bahawa anda telah menerima kebenarkan mereka untuk data peribadi mereka diproses (termasuk pendedahan dan pemindahan) data peribadi mereka berdasarkan Notis Privasi ini.
Hak anda di bawah PDPA
Keutamaan kami adalah memastikan bahawa data peribadi anda disimpan dalam keadaan selamat. Tempoh penyimpanan data peribada anda adalah bergantung kepada kepentingan data tersebut kepada perniagaan kami dan/atau seperti yang dibenarkan oleh PDPA. Anda mempunyai hak untuk meminta akses kepada, mendapat salinan, mengemaskini atau memperbetulkan data peribadi anda yang disimpan oleh kami dan untuk menghubungi kami berkenaan sebarang pertanyaan atau aduan mengenai data peribadi anda. Seperti mana kami mempunyai hak untuk bergantung kepada mana- mana pengecualian statutori dalam mengumpul, mengguna dan mendedahkan data peribadi anda, anda juga mempunyai hak untuk meminta kami menghadkan pemprosesan dan penggunaan data peribadi anda.
Anda diberi peluang untuk ‘memilih keluar’ mempunyai data peribadi anda yang boleh digunakan untuk memberikan maklumat tentang produk, perkhidmatan dan / atau perkhidmatan pihak ketiga dan
/ atau produk, yang mungkin menarik atau memberi faedah kepada anda. Jika anda memilih untuk ‘memilih keluar’, kami tidak akan dapat memberikan anda maklumat tersebut.

Permintaan atau pertanyaan tersebut atau sebarang pertanyaan berkaitan dengan pengumpulan dan pemprosesan data peribadi hendaklah secara bertulis dan dialamatkan kepada:

Pindaan kepada Notis Privasi ini
Kami berhak mengemaskini dan meminda Notis Privasi ini dari semasa ke semasa. Sebarang perubahan atau pindaan kepada Notis Privasi ini akan dimaklumkan melalui laman web kami atau melalui cara-cara lain yang bersesuaian. Jika kami meminda Notis Privasi ini, pindaan itu hanya akan berkuatkuasa untuk data peribadi yang dikumpul selepas kami memaparkan Notis Privasi kami yang terpinda.
Penggunapakaian versi Bahasa Inggeris
Mengikut Seksyen 7(3) PDPA, Notis Privasi ini diterbitkan dalam Bahasa Inggeris dan Bahasa Malaysia. Sekiranya terdapat sebarang ketidakseragaman atau percanggahan di antara versi Bahasa Inggeris dan Bahasa Malaysia, versi Bahasa Inggeris akan digunapakai.
